In California, APPs cannot work as 1099 contractors through an agency like Aya Locums because of state laws — mainly AB5, which sets strict rules on who qualifies as an independent contractor.
Under this law, a worker can only be 1099 if they are truly independent, do work that’s outside the agency’s main business, and run their own separate business. Since APPs are doing the core work of what we provide (healthcare staffing), they legally must be W-2 employees.
Trying to list them as 1099s could lead to serious penalties for both the agency and the client. That’s why APPs in California have to be W-2 when working through us. We do offer W2 benefits if needed (health, dental, vision, 401k, etc.)
